Applicable Regulations
Article 22, section two of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:
Service providers may use data storage and retrieval devices in recipients’ terminal equipment, provided that they have given their consent after being provided with clear and complete information on their use, in particular, on the purposes of data processing, in accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data.
When technically possible and effective, the consent of the recipient to accept the processing of the data may be provided through the use of the appropriate parameters of the browser or other applications, provided that the recipient must proceed to its configuration during its installation or update through an express action to that effect.
The foregoing shall not prevent possible storage or access of a technical nature for the sole purpose of carrying out the transmission of a communication over an electronic communications network or, to the extent strictly necessary, for the provision of an information society service expressly requested by the recipient.”
According to the “Guide on the use of cookies,” published by the Spanish Data Protection Agency (hereinafter, AEPD) in 2013 and its subsequent amendments, the LSSI-CE is applicable to any type of file or device that is downloaded to a user’s terminal equipment for the purpose of storing data that can be updated and retrieved by the entity responsible for its installation. A cookie is one of these widely used devices; therefore, from here on, we will generically refer to these devices as cookies.
The following cookies are exempt from compliance with the obligations established in Article 22.2 of the LSSI-CE:
Those used solely to allow communication between the user’s equipment and the network.
Those strictly used to provide a service expressly requested by the user.
1. TYPES OF COOKIES ACCORDING TO THEIR PURPOSE
A cookie is a file that is downloaded to your computer when accessing certain websites. Cookies allow a website, among other things, to store and retrieve information about the browsing habits of a user or their equipment and, depending on the information they contain and the way they use their equipment, they can be used to recognize the user.
According to the AEPD’s “Guide on the use of cookies,” we can distinguish between:
Technical cookies: These allow the user to navigate through a website, platform, or application and use the different options or services that exist therein, such as controlling traffic and data communication, identifying the session, or sharing content through social networks.
Personalization cookies: These allow the user to access the service with some predefined general characteristics based on criteria in the user’s terminal (e.g., language, browser type).
Analysis cookies: These allow the party responsible for them to track and analyze the behavior of users of the websites to which they are linked for the purpose of introducing improvements based on the analysis of usage data.
Advertising cookies: These allow for the most effective management possible of the advertising spaces included on a website.
Behavioral advertising cookies: These store information on user behavior obtained through continuous observation of their browsing habits, allowing for the development of a specific profile to display advertising based on it.

4. OPTIONAL NATURE OF COOKIE INSTALLATION

5. DATA SECURITY PRINCIPLE
Bio-Oils Group companies are committed to fulfilling their duty of confidentiality (Art. 5.1.f GDPR) and have adopted technical and organizational measures to prevent the alteration, loss, or unauthorized access to personal data.
6. EXERCISE OF RIGHTS
The user may at any time exercise their rights of access, rectification, erasure, restriction, and portability by contacting the data controller and providing a copy of their ID.
